Welcome to DATAGRIS CYBERSECURITY ("DATAGRIS," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.

1. Acceptance of Terms

By creating an account, submitting a scan, or accessing any DATAGRIS service, you acknowledge that you have read, understood, and agree to these Terms. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to use the platform. By registering, you represent that you have the legal authority to bind your organization to these Terms. You may not use the platform if you are located in a jurisdiction subject to US or EU trade sanctions.

3. Authorized Use Only

DATAGRIS provides tools for authorized security testing. You agree to:

Violation of this section will result in immediate account termination and may be reported to law enforcement.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

5. Subscriptions & Billing

Free-tier accounts are subject to daily scan limits. Paid subscriptions (Pro, Enterprise) auto-renew monthly or annually based on your selected plan. You may cancel at any time; access continues until the end of the billing period. Refunds are handled on a case-by-case basis.

6. Data Handling & Retention

Scan results, reports, and logs are stored securely and retained for 90 days on free plans, 365 days on Pro, and according to your DPA on Enterprise. You can export or delete your data at any time via the dashboard. See our Privacy Policy for details.

7. Limitation of Liability

DATAGRIS provides its platform "as is" without warranties of any kind. In no event shall DATAGRIS be liable for damages exceeding the amount paid by you in the 12 months preceding the claim. We are not responsible for damages resulting from authorized testing activities conducted using our tools.

8. Indemnification

You agree to indemnify and hold DATAGRIS harmless from claims arising out of your unauthorized use of the platform, violation of these Terms, or violation of applicable law.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your data will be deleted within 30 days unless required otherwise by law.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law provisions. Any disputes shall be resolved in the courts of Delaware.
